Judicial Misconduct and Conspiracy Cover Up In The Case Against Nuwaubian Leader Dr. Malachi Z. York 

 

In one of the most egregious wrongful convictions in U.S. history, despite overwhelming evidence of fraud upon the court, constitutional violations and witness tampering, the Eleventh Circuit Court of Appeals recently denied a petition for rehearing filed on behalf of Dr. Malachi Z. York misnomer Dwight D. York. Mr. York is currently serving a 135 year sentenc ae in ADMAX Florence, Colorado prison, and will turn 80 years old on June 26. 

 

The May and June 2025 filings revealed new evidence that: Isaam Williams was statutory raped by Nicole Renee Lopez in 2000 when he was fifteen and she twenty-five. Williams was threatened with jail time by the Putnam County Georgia Sheriff's Office when he reported the crime in 2002, at age seventeen. The age of consent in Georgia is sixteen. Rather than protect the child, the state told Williams the U.S. Attorney granted Lopez full immunity 46 days after William’s report. Williams was threaten into silence, deprived of justice, and did not testify in York’s trial out of fear. 

 

According to the filing, Lopez attended a 2001 meeting in South Beach, Florida, where she was an architect of a conspiracy to frame Dr. York with child molestation. Some of those present: Habiyba Washington aka Abigail who appeared in Hulu’s “ How I Escaped a Cult” , and Lopez's ex boyfriend 

Jacob York aka Yacuwb Johnson, Dr. York's estranged son who is affiliated with Diddy, Junior Mafia, 

Lil Kim, and Karrueche Tran, who were not part of the conspiracy . The conspiracy includes: Nicole 

Harden, Krystal Harden, Barbara Noel, Amala Noel, Taariq Noel, and other disgruntled ex-members of Dr. York's organization. Williams had first hand knowledge of the developing conspiracy in 2000, the real reason he was threatened with prosecution. 

The petition emphasized that Lopez's testimony was used to establish the alleged RICO conspiracy, timelines of abuse, and patterns connecting disparate claims into a fabricated narrative. Without her, the prosecution's case would have collapsed. The defense was never informed of Lopez's full immunity violating Brady v. Maryland and Giglio v. United States , nor was the jury inform that Williams had pressed charges against Lopez. 

 

Eight of the government's fifteen trial witnesses have since recanted their testimony, many citing law enforcement threats like Williams. The concealment of this exculpatory evidence paints a picture of a conviction tainted by systemic corruption. 

 

The appellate court declined to authorize a successive § 2255 motion prematurely, evaluating the merits, instead of assessing whether the new evidence meets the legal threshold under federal law. 

 

Attorney Imhotep Alkebu-lan argued this was "fraud upon the court" where federal agents, local law enforcement and prosecutors actively suppressed the truth. Their actions destroyed the integrity of the trial and violated York's right to a fair proceeding by suppressing a material witness. 

 

The Eleventh Circuit's decision signals an effort to protect the verdict rather than pursue justice. Dr. York's case demands a hearing. The conspiracy cover-up must end!
